Rehabilitation of Offenders Act 1974

An unspent conviction is a criminal conviction that is still in the bounds of the rehabilitation period. In other words, not enough time has elapsed for the offence to be considered spent. Unspent convictions show up on all types of DBS check - basic, standard, and enhanced. If your conviction is ‘spent’, you have a legal right not to disclose that conviction to people like employers and insurance agencies.
